Permacast's initial attempt to gain retrospective development application approval for their illegal concrete plant was unanimously rejected by council on 21 August 2023. This was a result of a motion moved by the now president of the Serpentine-Jarrahdale Shire, Rob Coales.
Council's rejection of the retrospective development application concluded as follows:
The development is inconsistent with State Planning Policy 4.1 - Industrial Interface as follows:
i. Emissions and impacts from the development extends beyond the boundaries of the site.
ii. The impact area of the development is not considered as a compatible zone.
iii. The development does not properly mitigate or manage impacts on health and amenity of people within the locality as it exposes them to noise, dust and vibration emissions.
On 02 November 2023, council posted yet another proposed retrospective development approval onto their website. This "second bite of the cherry" attempts to portray Permacast as being a caring environmental citizen with the updated submission tailored to paint a picture of zero emissions in terms of dust, noise and vibration. Basically telling the council what they want to hear.
